Reservation and Cancellation Policy for Casa los Suenos and La Casita del Rio

Nightly house rates are based on double occupancy. Additional people are $20/person per night for Casa Aire Libre, los Suenos and La Casita del Rio. We ask a 50% deposit at the time of booking and the balance is due upon arrival. Deposit payments can be made by PayPal and we ask that you pay the 5.4% commission. Cancellations’ made 60 days or more before the reservation will receive a refund of all monies received, less a cancellation fee of $50 USD. 13% tax is added to the rental total.

*Christmas and New Year’s reservations pay additional charges depending on the house.

Reservation and Cancellation Policy for Casa Playa Sombrero, Casa Rio Sombrero and Troya

A 50% deposit is required at time of booking. The balance is due upon arrival. Deposit payments can be made by PayPal and we ask that you pay the 5.4% commission . House rates are for up to 4 persons for Casa Playa Sombrero, Rio and Troya and 2 persons for Casa Tonka. Additional people are $25/person/night. 13% tax is added to the rental total.

*Christmas and New Years reservations pay an additional $60/night. $400/week.

Cancellations’ made with 60 days or more will receive a refund of all monies received, less a cancellation fee of $100 USD. For cancellations made with less than 60 days notice; If the period of rental can be re-booked, a refund for the period re-rented or the part thereof, less a cancellation fee of $100 USD will be issued. If any part of the rental period cannot be re-booked, the Renter will forfeit all monies paid for that period.

RENTAL AGREEMENT

This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date and between the guest and Osa Rainforest Rentals, pursuant to which the Guest has agreed to rent a residence (a “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.

CONDITION AND USE OF PROPERTY

The Property is provided in “as is” condition. Osa Rainforest Rentals shall use its best efforts to ensure the operation of all amenities in the Property, such as kitchen facilities etc. Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.

DEFAULT

If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.

RISK OF LOSS AND INDEMNIFICATION

Guest agrees that all personal property, furnishings, personal affects and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever.

RELEASE

Guest hereby waives and releases any claims against Osa Rainforest Rentals, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guest on or near or adjacent to the Property, including any common facilities, activities or amenities. Guest agrees to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.
